Terms of Service

01 Acceptance of Terms

By downloading, installing, or using the Vial mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Vial ("Company," "we," "us," or "our"). We reserve the right to update these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms.

02 Description of Service

Vial is a personal health tracking application designed to help users log and monitor peptide use, body metrics, and wellness data. The App provides:

• Dose and protocol tracking tools
• Weight and check-in logging
• Anonymized community statistics
• A vendor directory based on community feedback
• Educational information about research peptides

The App is intended solely for personal informational and tracking purposes.

03 Medical Disclaimer

• Nothing in the App constitutes medical advice, diagnosis, or treatment.
• All content is for informational and tracking purposes only.
• Always consult a licensed physician or qualified healthcare provider before starting, stopping, or modifying any health regimen, including peptide use.
• Vial does not sell, distribute, endorse, or recommend any peptide or supplement for human consumption.
• All tracking data is self-reported and should not be considered medically validated.

Reliance on any information provided by the App is solely at your own risk.

04 Eligibility

You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms. The App is not intended for use by minors.

05 User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the confidentiality of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

06 User-Generated Content

The App may allow you to submit reviews, ratings, notes, and other content ("User Content"). By submitting User Content, you:

• Grant Vial a non-exclusive, worldwide, royalty-free license to use, display, and distribute the content within the App
• Represent that you have the right to submit the content and that it does not violate any third-party rights
• Agree not to submit content that is false, misleading, defamatory, abusive, or illegal

We reserve the right to remove any User Content at our discretion.

07 Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Use automated tools to scrape, crawl, or extract data from the App
• Impersonate any person or entity
• Transmit malware, viruses, or other harmful code
• Interfere with the security or integrity of the App or its infrastructure
• Use the App to promote or facilitate illegal activities

08 Vendor Directory

Vendor listings in the App are based on community-submitted reviews and verification standards. Vial does not:

• Endorse, certify, or guarantee any vendor or product listed in the directory
• Verify the legality of any vendor's products or operations in your jurisdiction
• Accept responsibility for transactions, disputes, or issues arising from your interaction with any vendor

Use of vendor information is at your sole risk. Always conduct your own due diligence before engaging with any vendor.

09 Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, and software — are the exclusive property of Vial and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes only.

10 Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

11 Disclaimers and Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, VIAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

• Health outcomes resulting from information viewed in the App
• Loss of data or unauthorized access to your account
• Errors, interruptions, or unavailability of the App
• Actions or products of third-party vendors listed in the directory

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM USE OF THE APP SHALL NOT EXCEED $100 USD.

12 Indemnification

You agree to indemnify, defend, and hold harmless Vial and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in connection with your use of the App or violation of these Terms.

13 Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination will remain in effect.

14 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

15 Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, conducted in English.

You waive any right to participate in a class action lawsuit or class-wide arbitration.

16 Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the effective date at the top of this document. Your continued use of the App following any changes constitutes acceptance of the new Terms.
